This Privacy Policy explains what we collect, how we use it, who we share it with, and the rights you have over it. It applies to hyperfocusathletics.com and any order placed with us.
Who We Are
HyperFocus Athletics is a brand operated by HyperFocus, LLC ("HyperFocus," "we," "us," "our"), a Georgia limited liability company based in Atlanta, Georgia. You can reach us at info@hyperfocusathletics.com.
What We Collect
We collect the information you give us, the information we need to run our business, and basic technical information about how you use the site.
You Give Us Directly
- Name, email address, billing address, and phone number at checkout
- Payment card details (handled by our payment processor, never stored on our servers)
- Photos you upload for your graphic
- Intake information: school, sport, jersey number, school colors, college commitment details, milestone or award details, statement copy, reference designs, and similar order details
- Messages you send us through email, contact forms, or the custom inquiry form
We Collect Automatically
- Device, browser, operating system, IP address, and general location
- Pages viewed, time on site, referral source, and clickstream data
- Cookies and similar tracking technologies (see "Cookies" below)
How We Use It
We use the information to:
- Process your order, create your graphic, and deliver final files
- Communicate about your order, revisions, and delivery
- Respond to support requests and custom inquiries
- Prevent fraud, abuse, and chargeback risk
- Improve the site and the service (analytics)
- Show your finished graphic in our portfolio and marketing, as described in our Terms of Service (Section 8)
- Send occasional marketing emails (only if you opt in, with an unsubscribe link in every one)
- Meet legal, tax, and recordkeeping requirements
Photos and Likeness
Photos you upload to us are sensitive and we treat them that way.
- We store uploaded photos with Cloudinary, a third-party file storage provider
- We use your photos only to design your graphic and the related portfolio uses described in our Terms of Service
- We do not sell your photos, license them to third parties, or use them to train artificial intelligence or machine learning models
- You can request deletion of your raw uploaded photos at any time (see "Your Rights" below). We retain the finished graphic in our records for portfolio, tax, and legal purposes
Athletes Under 18
We design graphics for high school and college athletes. Athletes under 18 may only have an order placed on their behalf by a parent or legal guardian, who must accept our Terms of Service and this Privacy Policy.
We do not knowingly collect personal information from anyone under the age of 13. If you believe a child under 13 has submitted information to us, contact info@hyperfocusathletics.com and we will delete it.
Who We Share It With
We share information only with service providers we need to run the business, and only as much as they need. These include:
- Shopify (storefront, checkout, customer accounts, order data)
- Shopify Payments and other payment processors (payment card processing, fraud prevention)
- Cloudinary (photo upload storage)
- Email service providers (transactional emails, order updates, delivery)
- Analytics providers (site usage and performance, currently including Google Analytics or its equivalent)
- Lawyers, accountants, and other professional advisors when needed for legal, tax, or compliance reasons
We do not sell your personal information. We do not rent your personal information. We do not share your personal information with advertisers for cross-context behavioral advertising without your consent.
We may disclose information if required by law, subpoena, court order, or to protect our rights, property, or safety, or the rights, property, or safety of others.
How Long We Keep It
We keep information for as long as we need it to run the business and meet our legal obligations. As a general rule:
- Order and billing records: 7 years (tax and chargeback recordkeeping)
- Raw uploaded photos: 12 months after delivery, then deleted on a rolling basis (sooner on request)
- Finished graphics: indefinitely, for portfolio and reorder reference
- Marketing emails: until you unsubscribe
- Site analytics: as long as our analytics provider retains it (typically 14 to 26 months)
Cookies
We use cookies and similar technologies to keep the site working, remember your cart, and measure how the site is used. Some cookies are set by us and some by third parties (such as Shopify, Cloudinary, and analytics providers).
You can disable cookies in your browser settings. Disabling cookies may break parts of the site (checkout in particular).
Your Rights
Depending on where you live, you may have the right to:
- Request access to the personal information we hold about you
- Request correction of information that is inaccurate
- Request deletion of your information (subject to legal recordkeeping requirements)
- Opt out of marketing emails (use the unsubscribe link in any marketing email)
- Opt out of the sale or sharing of your personal information (we do not sell or share for cross-context advertising, but you can confirm)
- Request a copy of your data in a portable format
- Lodge a complaint with your local data protection authority
To exercise any of these rights, email info@hyperfocusathletics.com from the address on file. We respond within 30 days.
California Residents
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the rights listed above. We do not sell personal information as defined by the CCPA. We do not knowingly share personal information of consumers under 16 without consent.
EU and UK Residents
If you are in the EU, UK, or another jurisdiction with similar laws, you have rights under the GDPR or its equivalent. Our legal bases for processing are: performance of a contract (to fulfill your order), legitimate interests (to run our business and prevent fraud), consent (for marketing), and legal obligation (for tax and recordkeeping).
Data may be transferred to and processed in the United States. By using the site, you consent to that transfer.
Security
We use commercially reasonable safeguards to protect your information, including encryption in transit, restricted access, and vetted third-party processors. No internet service is 100% secure. If we ever experience a breach that affects you, we will notify you as required by law.

Our site may link to third-party sites. We are not responsible for the privacy practices of those sites. Read their privacy policies before sharing information with them.
Changes to This Policy
We may update this Privacy Policy from time to time. The "Effective Date" at the top reflects the most recent version. Material changes will be posted on this page. Continued use of the site after a change means you accept the new Policy.
